1. Acceptance of Terms
By accessing this website, purchasing course materials, or enrolling yourself or your child in music classes operated by Perth Music Craft, you agree to be bound by these Terms and Conditions.
2. Class Enrolment and Payments
Fees: Class fees are payable in advance at the time of booking via our online payment system, or in person at your first class. Please contact me if you desire to pay weekly, which may or may not be granted at my discretion. If agreed upon, payment must be organised prior to the commencement of each class, or your place in the class may be forfeited.
Pricing: All prices listed on our website are in Australian Dollars (AUD) and include GST (where applicable) unless otherwise stated.
Securing a Place: A place in a group class or individual lesson stream is only guaranteed once full payment has been received, or an agreed upon deposit has been given.
3. Child Safety, Supervision, and WA Health & Safety Compliance
Working with Children (WWC) Compliance: In accordance with the Working with Children (Screening) Act 2004 (WA), all instructors at Perth Music Craft hold current, valid WA Working with Children Checks.
Parental Consent & Supervision for Minors: Enrolments for students under 18 must be completed by a parent or legal guardian. Parents/guardians are responsible for ensuring minors arrive safely and are collected promptly at the conclusion of their class.
Work Health and Safety (WHS): Under the Work Health and Safety Act 2020 (WA), Perth Music Craft operates as a Person Conducting a Business or Undertaking (PCBU) and maintains a Primary Duty of Care. We ensure safe teaching environments (including cable management, stable equipment setup, and clear emergency access). Students and visitors are required to follow all safety instructions given on-site.
4. Cancellations, Rescheduling, and Refunds
Student Cancellations: If you need to cancel or reschedule a scheduled class, you must provide at least 24 / 48 hours notice. Cancellations made with less notice may result in forfeiture of the session fee.
Teacher Cancellations: If we must cancel a class due to illness or unforeseen circumstances, we will offer a makeup session, a credit toward future classes, or a full refund for that class.
Refund Policy: Our services come with guarantees that cannot be excluded under Australian Consumer Law. Except as required by law, fees for completed classes or missed sessions without adequate notice are non-refundable.

5. Intellectual Property, Copyright & Music Licensing
Copyright Act 1968: All custom teaching resources, arrangements, audio guides, and course content created by Perth Music Craft remain our exclusive intellectual property.
Sheet Music & AMCOS Licensing: All sheet music supplied during classes is provided in compliance with Australian copyright law and applicable AMCOS Print Music licensing terms. Students may not photocopy, digitize, or distribute sheet music or course materials provided during lessons without explicit permission. Where licensed original editions are required for learning or performance, students must acquire their own copy.
Recorded Music Licensing: Any playing of recorded music or sound recordings during classes, workshops, or performances is conducted under appropriate OneMusic Australia licensing (covering APRA AMCOS and PPCA rights).
Original Music and Class Content: All educational content, sheet music, audio recordings, arrangements, digital downloads, and website content provided by Perth Music Craft remain our exclusive intellectual property. Enrolment grants you a non-transferable, personal license to use these materials for individual learning purposes only. You may not reproduce, redistribute, or teach using our proprietary materials without prior written consent.
6. Concert Events & Student Performances
a) Event Participation & Registration
Eligibility: Participation in end-of-term recitals, community concerts, or choir/ensemble performances is optional unless specified as a mandatory component of a structured course.
Fees & Ticketing: Concert participation fees, venue hire contributions, or audience ticket sales are non-refundable once venue hire and event production costs are committed, except where required under Australian Consumer Law.
b) Public Performance Rights & APRA AMCOS Licensing
Licensing: All public recitals and concerts hosted by Perth Music Craft operate under appropriate OneMusic Australia (APRA AMCOS & PPCA) live performance licenses.
Arrangements & Sheet Music: Any custom backing tracks or arrangements performed live must comply with Australian copyright laws and AMCOS licensing guidelines.
c) Media Consent & Audience Photography
Official Recording: Perth Music Craft reserves the right to record or photograph performances for promotional and educational purposes, subject to our Privacy Policy and signed media consent forms.
Audience Recording Guidelines: Audience members (parents, guests, and attendees) taking personal photos or videos must do so unobtrusively without flash photography, blocking sightlines, or disrupting performers.
Child Protection: Photos or videos taken by audience members containing other minor students must not be uploaded to public social media platforms without the permission of those students' parents/guardians.
d) Venue Safety & Conduct (WA WHS Act 2020)
Venue Compliance: All concert venues utilized by Perth Music Craft adhere to Work Health and Safety Act 2020 (WA) standards, including emergency evacuation procedures and clear stage/backstage safety pathways.
Equipment & Stage Safety: Participants must follow all backstage, lighting, and electrical safety instructions issued by instructors or venue staff. Instruments, cables, and personal belongings must be stored safely in designated areas.
Supervision of Minors: Parents/guardians remain responsible for the supervision of minor students in foyer and audience areas before call times and immediately after the concert concludes.
e) Event Modifications & Cancellations
Unforeseen Venue Changes: In the event of venue unavailability, extreme weather, or circumstances beyond our control, Perth Music Craft will make reasonable efforts to reschedule the event or provide a digital performance platform.
7. Code of Conduct & Safety
We strive to maintain a respectful and supportive learning environment. We reserve the right to terminate enrolment without refund if a student engages in disruptive, illegal, or abusive behaviour toward instructors or fellow students.
8. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, Perth Music Craft is not liable for indirect, incidental, or consequential damages arising from class participation or website usage. Participants are responsible for ensuring that their personal instruments, resources, and technology meet the requirements for class participation.
9. Governing Law
These terms are governed by and construed in accordance with the laws of Western Australia.
